Idaho business newspaper wins ruling on legal ads

Joe Estrella of the Idaho Statesman reports Wednesday that the Idaho Business Review has won a state Supreme Court ruling that allows it to publish legal advertising.

The Statesman had argued that they should be published in the state’s largest circulation paper.

Estrella writes, “The court ruled for the Idaho Business Review, saying a state law that dictates where government and private legal notices must be published was unconstitutional. That means some private legal notices that both papers wanted, including foreclosures, name changes and probate notices, do not have to run in the Statesman, which argued that it reaches a much larger audience than the Business Review.

“Government legal notices are not affected.

“‘The Supreme Court ruling vindicates the rights of private parties to publish legal notices in the newspaper of their choice,’ said Newal Squyres, a lawyer for the Business Review.”
