The Arkansas Democrat-Gazette has sued for a contract for a West Memphis data center, and a judge has ruled that the case has to be considered by the Arkansas Public Services Commission.
Brett Barrouquere of the Democrat-Gazette reports, “The Democrat-Gazette sued the state Public Service Commission on June 18, seeking four documents under the state Freedom of Information Act. Business reporter Sydney Sasser requested on June 2 a special rate contract filed with the state between Entergy and Google, concerning a West Memphis data center.
“The commission turned over some records but denied access to others, and issued an interim order citing an exemption protecting trade secrets or proprietary information.
“Fox said final orders from the commission may be appealed directly to the Arkansas Court of Appeals. Interim orders are usually sorted out administratively before a final order is issued, Fox said. Attacking an interim order in circuit court is a ‘case of first impression,’ Fox said.”
